A BILL to amend article eleven, chapter twenty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section twenty, relating to authorizing the contractor licensing board to provide public education services through vocational schools to assist applicants in obtaining a contractor's license.

Be it enacted by the Legislature of West Virginia:
That article eleven, chapter twenty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section twenty, to read as follows:
ARTICLE 11. WEST VIRGINIA CONTRACTOR LICENSING ACT.

§21-11-20. Board authorized to provide training.

(a) The West Virginia contractor licensing board may enter into work-sharing agreements with state vocational and technical training schools to provide classroom training to students who desire to obtain a West Virginia contractor license. The purpose of the training is limited to instruction applicable to the contractor license examinations required by the board. Under the terms of the work-sharing agreements, the following apply:
(1) The board shall:
(A) Provide a course curriculum for each contractor classification for which instruction will be provided;
(B) Make available all necessary study materials which shall become the property and the responsibility of the school; and
(C) Shall provide funding, when available, to offset the cost of providing the instruction.
(2) The school shall:
(A) Adhere to the curriculum established and provided by the board;
(B) Provide from its staff an instructor qualified to provide the required instruction;
(C) Provide a classroom facility where the instruction may be conducted;
(D) Maintain an adequate supply of study materials; and
(E) Charge no admission fee to students unless specifically authorized by the board.SB406 S FIN AM #1

The Committee on Finance moved to amend the bill on page two, section twenty, line seven, after the word "board." by striking out the remainder of subsection (a) and inserting in lieu thereof the following: The terms of the work-sharing agreements shall be determined by the West Virginia contractor licensing board and county boards of education.

(b) For the purposes of this section, the board is authorized to expend funds from its special revenue account, known as the contractor licensing fund, to support this activity. Funding is to be limited to the availability of funds and may not exceed fifty thousand dollars annually.
